Welcome to Creator Program. These Terms and Conditions govern your use of our platform and services. By accessing or using Creator Program, you agree to be bound by these terms.

Creator Program is a product of TapTrap, LLC, a company registered in the United States.

1. Acceptance of Terms

By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Eligibility

To use Creator Program, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using our services, you represent and warrant that you meet these requirements.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep this information up to date.

4. Services Description

Creator Program provides a platform that allows content creators to earn money by posting videos about partner brands on social media platforms. Earnings are calculated based on video views within a specified time period after posting.

5. Content Guidelines

All content submitted through our platform must comply with our content guidelines and the terms of service of the respective social media platforms. We reserve the right to reject or remove any content that violates these guidelines or is deemed inappropriate.

6. Payments and Earnings

Earnings are calculated based on the performance metrics of your submitted videos. Payment rates and terms may vary by brand and are subject to change. Payments are processed through PayPal or other designated payment methods. You are responsible for any taxes applicable to your earnings.

7. Social Media Integration

Our platform integrates with third-party social media services to access your public content and engagement metrics. This integration is read-only; we cannot post, modify, or delete any content on your behalf. We only access non-sensitive, publicly available information necessary for our services.

8. Intellectual Property and Content License

You retain ownership of all content you create and submit through our platform. However, by submitting content to Creator Program, you grant TapTrap, LLC and its affiliated brands a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the services and our business operations.

This license specifically includes the right to:

  • Display your submitted content on our website and platform
  • Distribute and share your content across our social media channels (including but not limited to Instagram, TikTok, Facebook, Twitter, and YouTube)
  • Modify, edit, or transform your content for promotional, marketing, or operational purposes (including cropping, adding overlays, subtitles, or branding elements)
  • Use your content in advertisements, promotional materials, and marketing campaigns related to Creator Program or partner brands
  • Publish your content on partner brand websites and marketing materials
  • Display your name, username, social media handle, and profile information alongside your content
  • Create compilations, highlights, or showcase reels featuring your content

We will make reasonable efforts to credit you as the creator when displaying your content. This license remains in effect for the duration of your account and for a reasonable period thereafter to allow for ongoing promotional activities.

You represent and warrant that you have all necessary rights, licenses, and permissions to grant this license and that your content does not infringe upon any third-party intellectual property rights.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our sole discretion. You may also terminate your account at any time by contacting us. Upon termination, any pending earnings will be processed according to our payment schedule.

10. Limitation of Liability

Creator Program and TapTrap, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability shall not exceed the amount of earnings paid to you in the twelve months preceding the claim.

11. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of any material changes by email or through our platform. Your continued use of our services after such changes constitutes your acceptance of the updated terms.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Updates on Campaigns, Payments, and Responsibilities

Available campaigns on the platform may vary by brand and season. The maximum payout, payment per view, and participation requirements may change depending on each campaign and can be modified at any time by the campaign leader or the corresponding brand.

Each campaign leader reserves the right to:

  • Postpone a campaign
  • Cancel a campaign

These decisions will not affect posts that have already been approved and are active within the platform.

However, brands may make these changes without prior notice and assume no responsibility for modifications to the availability, conditions, or duration of campaigns.

14. Subscriptions Granted by Brands

Some brands may grant creators a subscription as part of the collaboration. The cost of such subscription will be automatically deducted from the user's first payout.

15. Commissions, Fees, and Taxes

The user is responsible for covering:

  • Commissions applied by payment platforms such as PayPal, Publika, or other external services
  • Any transfer fees
  • Any taxes applicable to their income

The platform is not responsible for:

  • Fees charged by external payment services
  • Withholdings
  • Taxes
  • Additional costs derived from the payment method selected by the user
